COLT and NIWRC LB Victory

NON-FEDERAL MOMENT

(Portland, OR., July 26, 2024)— On July 24, 2024, the Ninth Circuit Court of Appeals reversed the lower court’s decision in L.B. v. United States, stating that the lower court was wrong to grant summary judgment in the federal government’s favor and dismiss L.B.’s lawsuit under the Federal Tort Claims Act (FTCA). L.B.’s claims against the federal government stem from a sexual assault committed by a law officer from the Bureau of Indian Affairs (BIA) who raped her in her home after responding to her call for help. Both COLT and the NIWRC call on the United States, specifically the DOI and the BIA, to settle this case once and for all. The only correct response is for the United States to accept responsibility for the actions of its law officer, apologize, and compensate L.B. for her extreme losses. We hope the Biden Administration does the right thing. Indian Country is watching.

This position will focus on documentation development, controls, and training of processes and procedures to strengthen the support functions of the organization. This is a temporary position that will end in September 2025. The compensation range is $24-$28/hour, DOE. The position will remain open until filled.
